Boppy Pillow Recall Attorneys in Boston

In September 2021, Golden, Colorado-based Boppy Company recalled approximately 3.3 million of these baby loungers:

• Boppy Preferred Newborn Loungers
• Pottery Barn Kids Boppy Newborn Loungers

The Boppy Company sold the loungers at stores located throughout Massachusetts and the nation, including:

• Pottery Barn Kids
• Target
• Walmart

The company also sold the loungers online on Amazon.com.

The loungers were sold from January 2004 to September 2021 and retailed for $30 to $44. They came in various colors and designs and measured about 23 inches long by 22 inches wide and 7 inches high.

These Boppy loungers reportedly have been linked to eight infant deaths between 2015 and 2020. So that means Boppy Company knew or should have known of the danger associated with its loungers in 2015 but continued to sell the item without making any substantial changes and caused seven more deaths. And with more than three million Boppy Newborn Loungers sold, there may be more infant suffocation fatalities that have not been reported.

According to the Consumer Product Safety Commission, eight infants suffocated after they were placed on their backs, sides, or stomachs on the loungers. Parents reported that they set their infants on the product in a safe position but said the children fell asleep and rolled into a position that obstructed their breathing.

The CPSC warns that infants can suffocate if they roll, move, or are placed on the lounger in a position that interferes with breathing. The agency also cautions that babies can roll off the lounger and onto another surface, including soft surfaces like pillows or bedding that can obstruct a baby's breathing.

"Loungers and pillow-like products are not safe for infant sleep, due to the risk of suffocation," acting CPSC chairman Robert Adler said in a statement about the recall. "Since we know that infants sleep so much of the time-even in products not intended for sleep-and since suffocation can happen so quickly, these Boppy lounger products are simply too risky to remain on the market," he said.

This is not the first time Boppy Company has issued a product recall. In 2019, the company recalled Boppy Infant Head and Neck Support Accessories due to a suffocation hazard. According to the recall, the product's head pillow support area had the potential to be overstuffed and tilt a child's head too far forward. In this "chin-to-chest" position, a child's airway can become blocked, and the child can suffocate. Parents used the accessories in tandem with various baby products such as swings, strollers, and bouncers.

According to the CPSC, the best place for a baby to sleep is on a firm, flat surface inside a crib, bassinet, or play yard. The agency says parents and caregivers should never add blankets, pillows, or other items to a baby's sleep area and advises that babies always be placed on their backs for sleep.

Boston Children's Hospital says babies should sleep on their backs until they are one year old. The hospital says back sleeping greatly reduces the risk of Sudden Unexpected Infant Death Syndrome, or SUID.

As for the sleep environment, Boston Children's says cribs and other sleep areas should be empty. "Some brands of sleep equipment claim to reduce the likelihood of SUID; however, there is no evidence to support this claim," the hospital says.
